AI / Human Oversight and Compliance Notice

1. AI-Assisted Screening
TalentFora uses artificial intelligence and automated processes to assist in analysing CVs, resumes, job descriptions, and related candidate information. The Platform may generate candidate rankings, scores, summaries, skill matches, recommendations, insights, and other recruitment-related outputs.
2. Assistive Tool Only
TalentFora is provided strictly as an assistive technology only. The Platform does not make hiring, rejection, shortlisting, employment, promotion, compensation, assessment, or any other employment-related decisions.
3. Human Review Required
All Platform outputs must be subject to mandatory review by a human before being utilised in any recruitment or employment process. Employers, recruiters, and hiring teams remain exclusively responsible for applying their independent professional judgment and making all final decisions.
4. No Solely Automated Decisions
Users must not make decisions affecting candidates solely on the basis of TalentFora's AI-generated outputs. This strictly prohibits utilizing the Platform to automatically reject, shortlist, rank, hire, or otherwise conclusively evaluate a candidate without human intervention.
5. Limits of AI Outputs
AI-generated outputs may be incomplete, inaccurate, inconsistent, biased, or affected by the quality, completeness, or accuracy of the information uploaded to the Platform. FORASOFTWARE AUSTRALIA PTY LTD does not guarantee that the Platform will identify the optimal candidate, produce error-free results, or lead to any particular hiring or recruitment outcome.
6. Employer Responsibility
Employers, recruiters, and hiring teams are responsible for ensuring that their use of TalentFora complies with all applicable workplace laws, including the Fair Work Act 2009 (Cth), state and federal anti-discrimination legislation, the Privacy Act 1988 (Cth), and any other applicable AI-related laws and regulatory frameworks.
7. Data Protection & Privacy Law Alignment
In providing the TalentFora platform, we process personal information in strict accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Candidates and users maintain the right to request access to, and correction of, their personal information. Any privacy-related inquiries, requests, or complaints should be directed to our Privacy Officer. If a user or candidate believes a breach of the APPs has occurred, they have the right to lodge a formal complaint with the Office of the Australian Information Commissioner (OAIC).
8. International Data Transfers
To facilitate the operation, support, and continuous improvement of the Platform, personal information may be transferred to, and processed by, overseas recipients. This includes our dedicated development centre, Softfoora Services Pvt. Ltd., located in India, as well as our international cloud infrastructure providers. In accordance with APP 8 (Cross-border disclosure of personal information), FORASOFTWARE AUSTRALIA PTY LTD takes all reasonable steps to ensure that such overseas recipients do not breach the APPs in relation to the transferred personal information.
9. Limitation of Liability & Australian Consumer Law (ACL)
To the extent permitted by law, including the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), all implied warranties, guarantees, and conditions not expressly set out in this Notice are excluded. Nothing in this Notice restricts, excludes, or modifies any non-excludable statutory rights or guarantees consumers may have under the ACL. Where our liability cannot be lawfully excluded, it is limited, at our absolute discretion, to the re-supply of the services or the payment of the cost of having the services supplied again.

11. Governing Law and Jurisdiction
This Notice, its subject matter, and any associated disputes or claims shall be governed by, and construed in accordance with, the laws of New South Wales and the federal laws of Australia. The parties irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia.
