TalentFora Cancellation & Refund Policy

1. Introduction
1.1 Purpose of This Policy
This Cancellation & Refund Policy explains how cancellations, renewals, refunds, website credits, service credits, promotional credits, failed payments, and chargebacks are handled for the TalentFora Platform.
TalentFora is a subscription-based, AI-assisted resume scanning and candidate assessment platform. The Platform operates strictly as an assistive technology requiring mandatory human oversight and does not engage in solely automated decision-making. TalentFora may also offer free trials, promotional codes, and website credits from time to time.
1.2 Company Structure
TalentFora is a product of the Forasoftware group. The Platform is developed by Softfoora Services Pvt. Ltd.
For customers operating under this agreement, TalentFora is sold, operated, and supported by FORASOFTWARE AUSTRALIA PTY LTD (ACN: 685 226 706 / ABN: 25 685 226 706), with its principal place of business at U 1 29 HELEN ST. NEWTOWN QLD 4350.
In this Policy, "TalentFora", "we", "us", or "our" refers to FORASOFTWARE AUSTRALIA PTY LTD, providing or contracting for the Platform with you.
1.3 Relationship With the Terms & Conditions
This Policy should be read together with the TalentFora Terms & Conditions, Privacy Policy, Cookie Policy, and any other applicable policies, notices, or addenda made available by TalentFora. If there is any conflict between this Policy and the Terms & Conditions, the Terms & Conditions will apply unless required otherwise by applicable Australian law.
2. Subscriptions, Trials and Credits
2.1 Subscription Plans
TalentFora may offer paid subscription plans, usage-based plans, credit packages, or other pricing models made available on the Platform or agreed with a customer. Details of applicable fees, billing cycles, subscription terms, usage limits, included features, and credit allowances will be made available at the point of purchase, within the Platform, or in a separate order form or written agreement.
2.2 Free Trials
TalentFora may offer free trials from time to time. Unless otherwise stated at the point of registration, free trials may be limited by time, usage, features, number of CVs processed, number of credits, or other limits set by TalentFora. If payment details are required to start a free trial, TalentFora will explain when paid billing begins. If you do not wish to continue on a paid plan, you must cancel before the trial converts into a paid subscription. Unused free trial access or credits have no cash value.
2.3 Promotional Codes and Website Credits
TalentFora may provide promotional codes, discounts, website credits, or usage credits. Promotional codes and credits:
- may be limited by time, account, organisation, plan, feature, region, or usage volume;
- may not be combined with other offers unless expressly stated;
- are not redeemable for cash unless required by applicable law;
- may not be transferred, resold, or exchanged;
- may expire if not used within the stated period;
- may be withdrawn, refused, or cancelled if used fraudulently, unlawfully, or in breach of the Terms & Conditions.
3. Payments and Billing
3.1 Payment Processing
Payments may be processed through third-party payment providers, including Stripe and Razorpay, or other payment providers made available by TalentFora from time to time. By purchasing a subscription, credit package, or paid service, you authorise TalentFora and/or its payment provider to charge the applicable fees using the payment method provided. TalentFora does not store full payment card details on its own systems.
3.2 Billing Information
You are responsible for providing accurate, complete, and current billing information. If your payment information changes or becomes invalid, you are responsible for updating it promptly.
3.3 Account-Based Access
Users are required to create an account to use the Platform. You are responsible for maintaining the security of your account login details and for all activity that occurs under your account, unless caused by TalentFora's own breach of duty or as otherwise required by applicable law.
4. Renewals and Cancellation
4.1 Subscription Renewals
Paid subscriptions may renew automatically at the end of each billing period unless cancelled before the renewal date. You are responsible for managing your subscription and cancelling before renewal if you do not wish to continue.
4.2 Cancellation by Customer
You may cancel your subscription through the Platform, where cancellation functionality is available, or by following the cancellation instructions made available within your account, order form, invoice, or other customer communications. Unless otherwise stated in your order form or agreed in writing, cancellation will take effect at the end of the current billing period. You will normally continue to have access to paid features until the end of the current billing period, subject to the Terms & Conditions and any applicable usage limits.
4.3 Effect of Cancellation
Cancelling your subscription stops future renewals. It does not automatically entitle you to a refund for unused time, unused credits, or partial use of the Platform, subject to your non-excludable rights under Australian law.
5. Refunds and Service Credits
5.1 General Refund Position
To the extent permitted by law, including any non-excludable rights or consumer guarantees under the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), and except where expressly agreed by TalentFora in writing, fees paid for subscriptions, usage credits, promotional packages, or other paid services are non-refundable.
5.2 Website Credits as Preferred Remedy
Where TalentFora agrees to provide a refund, adjustment, goodwill remedy, or compensation, TalentFora may issue that refund or adjustment as website credits or service credits instead of a cash refund, unless the Australian Consumer Law or other applicable law requires otherwise.
Website credits or service credits:
- may be applied to future eligible TalentFora services;
- are not redeemable for cash unless required by law;
- may be subject to expiry dates or usage restrictions;
- may not be transferred, resold, or exchanged;
- may be revoked if obtained through fraud, misuse, chargeback abuse, or breach of the Terms & Conditions.
5.3 Exceptional Refunds or Credits
Subject to the ACL, TalentFora may, at its discretion, consider a refund, partial refund, website credit, or service credit where:
- there has been a duplicate charge;
- an incorrect amount has been charged due to a billing error;
- the Platform has experienced a material service failure that prevents meaningful use of the paid service and the issue cannot be resolved within a reasonable time;
- a refund or credit is required by applicable law or payment provider rules;
- TalentFora agrees to a refund or credit in writing.
Any discretionary refund, partial refund, website credit, or service credit is not an admission of liability and does not create an obligation to provide similar remedies in the future.
6. Non-Refundable Situations
To the extent permitted by law, including the Australian Consumer Law, and unless expressly agreed by TalentFora in writing, TalentFora does not provide refunds for:
- unused time in a subscription period;
- failure to cancel before a renewal date;
- partial use of the Platform;
- unused paid credits;
- unused promotional credits;
- change of mind;
- lack of use by the customer or its team;
- dissatisfaction with AI-generated outputs, scores, rankings, summaries, or reports;
- hiring, recruitment, employment, or business outcomes resulting from use of the Platform;
- issues caused by inaccurate, incomplete, unlawful, or poor-quality data uploaded by the customer;
- suspension or termination caused by breach of the Terms & Conditions or this Policy.
TalentFora is an assistive tool only, requiring mandatory human oversight, and does not engage in solely automated decision-making. It does not guarantee that any candidate will be hired, shortlisted, rejected, contacted, selected, or suitable for any role.
7. Failed Payments and Chargebacks
7.1 Failed Payments
If a payment fails or remains unpaid, TalentFora may notify you and request that you update your payment method or settle the outstanding amount. If payment is not made within the required timeframe, TalentFora may suspend, restrict, or terminate access to the Platform in accordance with the Terms & Conditions. You remain responsible for all fees properly incurred before cancellation, suspension, or termination.
7.2 Chargebacks and Payment Disputes
If you believe a charge is incorrect, you should contact TalentFora through the billing or support contact details made available on the Platform, in your account, or in relevant customer communications so that the issue can be reviewed. Where a chargeback, reversal, or payment dispute is raised, TalentFora may suspend or restrict access to the account while the matter is investigated. TalentFora reserves the right to dispute chargebacks where it believes the charge was valid, authorised, or consistent with this Policy and the Terms & Conditions.
8. Account Access, Data Protection, and Privacy
8.1 Account Access After Cancellation
After cancellation or termination, access to your account, uploaded CVs, candidate information, outputs, rankings, scores, summaries, reports, or other Platform materials may be limited, disabled, deleted, or retained only for the period described in the Terms & Conditions, Privacy Policy, Data Processing Addendum, account settings, or applicable order form. You are responsible for exporting any permitted data you need before cancellation takes effect. Where candidate data or Platform outputs are downloaded, exported, or otherwise accessed outside the Platform, you remain responsible for their subsequent use, storage, sharing, transfer, retention, deletion, and legal compliance.
8.2 Data Protection and Privacy Law Alignment
All processing of personal information by FORASOFTWARE AUSTRALIA PTY LTD is governed strictly by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Users and data subjects retain all statutory rights to access, correct, or make complaints regarding their personal information in accordance with the APPs. Any unresolved privacy complaints may be escalated to the Office of the Australian Information Commissioner (OAIC).
8.3 International Data Transfers
In strict compliance with APP 8 (Cross-border disclosure of personal information), you acknowledge that personal information processed by the TalentFora platform may be accessed by our development centre (Softfoora Services Pvt. Ltd. based in India) and our designated cloud infrastructure providers. TalentFora has taken, and will continue to take, reasonable steps to ensure that these overseas recipients do not breach the APPs in relation to the personal information transferred.
9. Governing Law and Jurisdiction
This Policy, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of New South Wales and the federal laws of Australia. You irrevocably agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, to settle any dispute or claim that arises out of or in connection with this Policy or its subject matter.
10. Changes and Contact
10.1 Changes to This Policy
TalentFora may update this Policy from time to time. Where changes are material, TalentFora will take reasonable steps to notify affected customers. Changes will normally apply to future billing periods, future purchases, or future use of the Platform, unless otherwise required by law.
